August 17, 2009:
This is the legal brief filed with the court stating our reasons that the BOCC approved partial annexation was illegal. It was limited to 75 pages and was filed after discovery including nearly a year of game playing and delay tactics by the other side.
October 5, 2009:
After we filed our legal brief, the City and County filed briefs disputing our information. This document is our reply (or in legal terms, the sur-reply) to their briefs stating why their briefs are full of incorrect information. It was limited to 35 pages. The City and County then filed sur-replies to our sur-reply.
October 23, 2009:
No document for this date, but it was the day that the judge heard oral arguments in the case. No ruling has yet been made. The legal briefs and sur-reply briefs above are legal documents that he can utilize in the ruling.
November 9, 2009:
Prior to issuing his ruling, the judge asked each side (plaintiffs and defendants) to send him their proposed Findings of Facts on the case. The judge will issue a Findings of Fact when he rules and he is free to use the documents from the plaintiffs and defendants in his document.
November 20, 2009:
After both sides sent in their proposed Findings of Fact documents, they were allowed to file reply documents in response. This is our response to the City and County proposed Findings of Fact.
